NOTICE OF ORDINANCE ADOPTION

 

PLEASE TAKE NOTICE that the City Commission of the City of Buchanan, Berrien County, Michigan, adopted Ordinance No. 2026.03/447 at its Regular Meeting held on Monday, March 9, 2026.

 

Ordinance No. 2026.03/447 is an Ordinance to amend Chapter 18, Business, Article V Utilities to add Article V, Section 18-191-196, titled “Regulation of Sidewalk cafes and outdoor service areas.”

The City regulates sidewalk cafés in Downtown Zoning Districts. Any business wishing to place tables, chairs, or other outdoor furnishings on a City-owned sidewalk for food or beverage service must first obtain a permit from the City Clerk. Permits are required before operation, are valid May through October, and must be renewed annually. Applicants must submit a completed application, including a site plan and operational details, at least 30 days prior to opening. Operators must maintain clear pedestrian access, comply with all applicable laws and permit conditions, and maintain required insurance coverage.

Violations may result in permit revocation, civil fines, and other penalties.
