July 27 2009 Minutes

CITY OF BUCHANAN COMMISSION MINUTES
July 27, 2009

The regular meeting of the City Commission was held at the Buchanan Common, Days Avenue, Buchanan, Michigan, Monday, July 27, 2009.  Mayor Clark called the meeting to order at 7:00 p.m.
  
The Pledge was recited by all in attendance.  No Invocation was heard.

Commissioners present:  Barbara Clark, Carla Cole, Patricia Moore, William Norton,Warren Weaver
Commissioners absent:   None
Staff present:      Meg Mullendore, City Manager, Police Chief Bill Marx, and City Clerk Gladys Bybee
Guests/Visitors present:  24 visitors 
    
Several persons in attendance spoke in favor of the proposal to repair the Mill Race with one opposing.  Receipt of a letter favoring the repair of the Race was acknowledged.

After request from the clerk to add item to the Consent Calendar and item to New Business, Cole moved, seconded by Moore to amend the Consent Calendar to include G. Appoint Tyler York to the Fine Arts Council and include Item B. Change FOIA Coordinator to the City Manager and City Attorney under New Business.  Roll call vote carried unanimous.  Cole moved, seconded by Weaver to approve the Agenda as amended.  Roll call vote carried unanimous.

• Checks 57609 to 57695 in the amount of $401,870.81
• Re-appointments to the Brownfield Redevelopment Authority: Dave Hagey as DDA Chairman and Meg Mullendore as City Manager for a three year term ending 2012
• Re-appointment of Mayor Barbara Clark and City Manager Meg Mullendore for a year term ending July 2010 to the Southeast Berrien County Landfill Board
• Approve Subordination Agreement for 101, 103, 105 E. Front Street and 104 N. Oak Street
• Appoint Tyler York to the Fine Arts Council for a three year term ending 2012

Chamber of Commerce President Alice Kring distributed the Schedule of Events for 2009 Old Mill Fest and summarized other projects the Chamber was involved with.

Moore made the motion that the City Manager pursues all necessary permits to remediate the Mill Race, including reconstruction and/or repair of the weir, dredging of the Mill Race and any other necessary recommendation as presented in the Wetland and Coastal Resources Findings. Further, that the City take the necessary action to clean out the existing sediment trap upstream at the head of the Creek and the Race.  In conclusion that the Mayor goes to the next DDA meeting with a motion from the City Commission: that they turn over ownership of Clark Park, known as the Duck Pond, to the City so that the City may continue to care for and maintain the park including pursuing a permit to dredge the pond. Cole seconded the motion and role call vote carried unanimous.

Mullendore summarized the RFP to complete a feasibility study to determine which building (5/3 Bank or current building) would best suit the needs for a New City Hall and recommended the low bidder with a score of 95 points.  Moore moved, seconded by Norton to award of Buchanan City Hall Facility Architectural Services to Abonmarche in the amount of $6,000 as explained and recommended.  Roll call vote carried unanimous.

Mullendore reported that due to high Attorney costs for Freedom of Information Act (FOIA) requests she recommends that she and the City Attorney be the FOIA Coordinators. Cole moved, seconded by Moore to appoint the City Manager and City Attorney as Coordinators for Freedom of Information Act requests as recommended.  Roll call vote carried unanimous.

Cole moved, seconded by Norton to adjourn the meeting at 7:51 p.m. Roll call vote carried unanimous.
